Indiana Judge Rules That Tacos are “Sandwiches”

It’s a debate you’ve probably had once or twice in your life… “Are tacos a sandwich?” The same can be asked about hot dogs. But according to a judge in Indiana tacos are definitely sandwiches, and so are burritos.

The ruling was made on May 13th, but the question is, what happened for this to be brought up in a court of law? A business owner has been attempting to open a restaurant (Famous Taco) at a strip mall in Fort Wayne but had been battling with the city commissioner over the type of establishment it would be. In order to prevent big-chained fast food restaurants, the strip mall only allows establishments that offer “made-to-order or subway style sandwiches” so the Famous Taco was denied.

As a response, the restauranteur sued claiming that tacos and burritos are sandwiches, and the judge sided with him.

The Court agrees with Quintana that tacos and burritos are Mexican-style sandwiches, and the original Written Commitment does not restrict potential restaurants to only American cuisine-style sandwiches.

In this case, I am happy that this guy gets to open his restaurant, but I stand by the fact that tacos are tacos and hot dogs are hot dogs – not sandwiches.
