1. PROMOTION DATES
These rules (the “Official Rules”) govern the Hot 104.5 The Hot Clock Sweepstakes (“Promotion”) which will begin on May 14, 2018 at or around 10 am Eastern Time (“ET”) and end on June 1, 2018 at or around 8:00 pm ET (the “Promotion Period”). The Promotion will be divided into three weekly periods (each, a “Weekly Period”). The first Weekly Period will run from May 14, 2018 at or around 10:00 am ET to May 18, 2018 at or around 8:00 pm ET; the second Weekly Period will run from May 21, 2018 at or around 10:00 am ET to May 25, 2018 at or around 8:00 pm ET; and the third Weekly Period will run from May 29, 2018 at or around 10:00 am ET to June 1, 2018 at or around 8:00 pm ET.
2. ELIGIBILITY RESTRICTIONS
a. The Promotion is open to all legal U.S. residents who are 18 years of age or older at the time of entry and who live in the state of Tennessee (the “Promotion Area”) and within the terrestrial, over-the-air broadcast signal of the radio station. Employees of Scripps Media Inc., d/b/a WKHT (the “Promoter” or “Station”), its corporate parent, subsidiaries, and affiliated entities, and of the advertising agencies, participating and sponsors/promotional partners associated with this Promotion, and of the other broadcasting stations in the Knoxville, TN metropolitan area, and the members of those individuals’ immediate families (spouse, parents, siblings or children) or households (whether related or not) are ineligible to participate or win. Void where prohibited and outside the Promotion Area. By participating, entrants agree to be bound by the Official Rules and the decisions of Promoter, which are final.
b. Individuals may win a Promoter promotion only once every 60 days, including all contests or promotions conducted by Star 102.1/WWST, Q100.3/WCYQ, and 93.1/WNOX.
c. Winner must hold a valid government-issued driver’s license prior to participating in this Promotion.
d. Entrants are required to provide truthful information, and Promoter will reject and delete any entry that it discovers to be false or fraudulent. Promoter will disqualify any entry from individuals who do not meet the eligibility requirements. , and Promoter will also delete any entry knowingly received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act and as otherwise required by law.
3. ENTRY AND QUALIFIER SELECTION AND VERIFICATION
a. To enter, listen to the Station weekdays during the Promotion Period, except for Monday, May 28th, during the 11:00 am, 1:00 pm, 3:00 pm, 5:00 pm and 7:00 pm ET hours, except on Fridays, when qualifying times will be 11:00 am, 1:00pm and 3:00 pm. When the Hot Clock sounder plays, listeners will be asked to keep track of the titles of the next four songs that air. When the fourth song starts, the first successful caller thru on the Station contest line at (865)-656-1045 will qualify if the caller is able to correctly name the titles of the four songs that played after the Hot Clock sounder within 10 seconds upon confirmation of eligibility will qualify for the Grand Prize drawing for that Weekly Period (each deemed a “Qualifier”). The Station will be the sole judge in determining if the caller correctly identified the four songs. If the caller incorrectly identifies any song, no Qualifier will be selected for that hour. If qualifier is successful in naming all 4 song titles correctly, qualifier must then listen in the 5pm hour that Friday for their name to be called, and call the station back within 10 minutes and 45 seconds at (865)-656-1045 in order to claim their Grand Prize for that week’s contesting. If the first qualifier does not call back, a second qualifying name from that week will be called, and they will have 10 minutes and 45 seconds to call back, and so on, until a qualifier is named a winner. Listeners may qualify once per week, for a total of 3 times per contest run. Listeners may only win 1 Grand Prize. At the time of their call, entrants must provide all requested information, including, their first name and last name, complete address, city, state, zip code, email address, telephone number, and date of birth. Use of any device to automate entry is prohibited. The Promoter’s telephone system is the official time keeping device for the Promotion. Listeners may qualify only once per Weekly Period. Promoter is not responsible for interrupted, distorted, or incorrect broadcast information, or calls not received for any reason.
b. Up to 23 Qualifiers will be selected on-air per Weekly Period (up to 18 for the third Weekly Period). On-air Qualifiers will be notified at the time of their phone call. There is no prize associated with being a Qualifier. If a potential Qualifier is not in compliance with these Official Rules or does not meet the eligibility requirements, the Qualifier position will be forfeited. If a Qualifier is disqualified, no alternate will be awarded for that particular Qualifier position.
c. The Station reserves the right to delay the announcement of the cue to call if breaking news or other unanticipated events prevent the Hot Clock from occurring as scheduled. If such changes occur, they will be posted on the Station’s website. For those viewing/listening to the Station stream on the Internet or other non-broadcast means: Please be advised that you may be listening to a delayed stream of the broadcast signal, which may vary depending on your computer’s memory capacity and your connection. For that reason, we strongly recommend that you turn on your radio to the Station to participate in this Promotion to be sure you are participating in “real time.” The Station assumes no responsibility for entrants not making timely phone calls to the Station as a result of the delays in the method of viewing/listening.
d. For those viewing/listening to the Station stream on the Internet or other non-broadcast means: Please be advised that you may be listening to a delayed stream of the broadcast signal, which may vary depending on your computer’s memory capacity and your connection. For that reason, we strongly recommend that you turn on your radio to the Station to participate in this Promotion to be sure you are participating in “real time.” The Station assumes no responsibility for entrants not making timely phone calls to the Station as a result of the delays in the method of viewing/listening.
4. WINNER SELECTION AND NOTIFICATION
a. Grand Prize winners will be selected as follows:
- On Friday, May 18, 2018, one Grand Prize winner will be selected in a random drawing from all Qualifiers selected from the first Weekly Period.
- On Friday, May 25, 2018, one Grand Prize winner will be selected in a random drawing from all Qualifiers selected from the second Weekly Period.
- On Friday, June 1, 2018, one Grand Prize winner will be selected in a random drawing from all Qualifiers selected from the third Weekly Period.
Non-selected Qualifiers will not rollover into subsequent Grand Prize random drawings. Promoter will attempt to notify potential Grand Prize winner by telephone promptly following the Grand Prize drawing.
b. Odds of a Qualifier winning a Grand Prize are up to 1:23 for the first two weeks of contesting, up to 1:18 in the third week of contesting.
c. Entrants must listen to the Station, but need not be present to be deemed a Qualifier. Qualifiers must listen to the Station to win the Grand Prize.
d. Promoter will contact Grand Prize winners via phone or email following winning on air with all details of contest prize. Winners must execute and return any required affidavit of eligibility and/or liability/publicity release (TN residents are not required to sign publicity release) and provide required identification within five days after Promoter sends documents to winner. If a potential winner does not respond to initial notification attempt within 24 hours, cannot travel on the specified dates, is not in compliance with the Official Rules (including eligibility requirements), fails to complete, sign and return the required affidavit of eligibility and liability/publicity release and provide required identification within the required time period, or if a prize or prize notification is returned as undeliverable, potential winner will be disqualified and will forfeit the prize and an alternate winner may be chosen (time permitting) by random drawing from among all remaining Qualifiers for that Weekly Period.
a. One Grand Prize will be awarded per Weekly Period for a total of three Grand Prizes. The Grand Prizes will be awarded as follows:
First Weekly Period: Two tickets to see Kendrick Lamar at Lakewood Amphitheatre in Atlanta, GA on May 25th, 2018 (courtesy of Interscope Records) and a one-night hotel stay (standard room, double occupancy) in Atlanta, GA or surrounding area on May 25, 2018. Approximate Retail Value (“ARV”) of this prize is $500. No other expenses are included in this prize.
Second Weekly Period: Two tickets to see Childish Gambino at Infinite Energy Center in Duluth, GA on September 6, 2018 (courtesy of Interscope Records) and hotel accommodations in Duluth, GA or surrounding area (standard room, double occupancy) the night of September 6, 2018. ARV of this prize is $500. No other expenses are included in this prize.
Third Weekly Period: Two tickets to see Jay Z and Beyonce at Bridgestone Arena in Nashville, TN (courtesy of Columbia Records) on August 23, 2018 and hotel accommodations in Nashville, TN or surrounding area (standard room, double occupancy) the night of August 23, 2018. ARV of this prize is $500. No other expenses are included in this prize.
b. All prizes are awarded as-is. There is no substitution, transfer, or cash equivalent for prizes, except that Promoter may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Promoter is not responsible for winners’ limitations that prevent acceptance, use, or nonuse of prize. Entrants acknowledge that the Released Parties, as defined herein, have not made, nor are in any manner responsible or liable for, any warranties, representations or guarantees, and hereby disclaim any and all warranties expressed or implied, in fact or in law, whether now or hereafter enacted concerning any prize, including without limitation, implied warranties of quality, merchantability, mechanical condition, or fitness for a particular purpose, except for any express manufacturer’s warranty as may be included with the prize or as may be separately provided to participants by law. Guest of winner (and parent or legal of guest who is a minor) may be required to sign and return release prior to accompanying winner on prize vacation. Guest who is a minor must be accompanied at all times by parent or legal guardian.
c. Any prize certificates, tickets, or coupons are subject to the terms and conditions as set forth by the issuer of the certificate, ticket, or coupon. Such certificates, tickets, and coupons are not refundable or transferable, and may not be substituted or exchanged for cash or credit at any time, nor will such certificates or coupons be replaced if unused, lost, stolen, or damaged. Seat location at concerts in the sole discretion of Sponsor.
d. Certain travel restrictions may apply. Prize is subject to availability. The winner and guest(s) must travel on the same itinerary and are responsible for obtaining all required travel documents. If applicable, the winner may be required to present a valid credit card upon hotel check in to cover any incidental expenses incurred during the winner’s stay. If a prize-related event is unable to take place as scheduled, for reasons such as cancellation, preemption, postponement or unavailability, or for any reason beyond the control of the Promoter, Promoter may award the winner the remaining available portion of the prize and no substitution or compensation will be provided for the unawarded portion of the prize.
e. Use of concert tickets is subject to all rules and restrictions of the performer and the venue. Promoter and prize provider will not be responsible for weather, talent illness or other inability to perform, acts of God, acts of terrorism, civil disturbances, strike, work stoppage, or any other natural disaster outside their control that may cause the cancellation or postponement of the concert, and the terms and conditions of the tickets will govern in such event. Seat location is in the sole discretion of Promoter. Promoter will not replace lost, stolen or damaged prize tickets or similar items once they have been given to winner. All prize details will be at Promoter’s sole discretion. If winner is unable to attend concert on designated date at designated time, prize will be forfeited. Prize offered is provided “as is” with no warranty or guarantee either express or implied by Promoter or prize provider.
f. All prizes or prize certificates may be picked up at the office of the Promoter at the address below. The winner will forfeit any prize or prize certificate not claimed within five days of winning (or sooner if notified by Station at the time of notification). Prize or prize certificates may also be mailed to the winner with the winner’s prior written consent in which the winner shall agree to assume its risk of loss. The Promoter, its sponsor, or promotional partner are not responsible for the safe arrival of a prize or prize certificate.
- Payments of all federal, state and local taxes are solely the responsibility of the winners. Winners will be required to complete and submit an IRS Form W-9 or the equivalent including the winner’s full Social Security Number for receipt of any prize valued at $600 or more or for any prizes awarded by Promoter in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in disqualification and forfeiture of the prize.
b. Participating in the Promotion and acceptance of any prize constitutes each entrant’s and winner’s (and guest’s where applicable) permission for the Promoter or its agents to photograph, film, record that entrant, winner ,or guest and to use his or her name, city, state, voice, or likeness, and any statements made by him or her regarding the Promotion or its sponsors for purposes of trade, publicity or promotion without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.
c. Prior to awarding any prize or prize certificate, and depending on the nature of the prize and eligibility requirements of the Promotion, the Promoter in its sole discretion will require verification of Promotion winner’s identification by a showing of valid government-issued photo identification. By entering, participating and/or accepting a prize in the Promotion, each entrant, winner, and guest if applicable, agrees not to sue and to release, discharge, indemnify, hold harmless, and absolve the Promoter, its sponsors and promotional partners, its advertising and promotion agencies, Interscope, Live Nation, Epic Records, and each of their respective parent, subsidiary and affiliated entities and the officers, shareholders, directors, employees, agents, and representatives and the successors and assigns of each of them (the “Released Parties”) from and against any and all claims, demands, actions, suits, losses, expenses, costs, damages, and liabilities including, without limitation, interest, penalties, court costs and reasonable attorneys’ fees and expenses arising directly or indirectly from the prize or participation in the Promotion, including, but not limited to, personal injury, death, or damage to or loss of property, which may occur in connection with, preparation for, travel to, or participation in Promotion, or possession, acceptance and/or use or misuse of prize or participation in any Promotion-related activity, including but not limited to any claims based on publicity rights, defamation, or invasion of privacy and merchandise delivery. Except where prohibited, by entering the Promotion, each entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize must be resolved individually, without resort to any form of class action, and the state or federal courts situated in Hamilton County, Ohio will be the exclusive venue for any such action; (2) any and all claims, judgments and awards will be limited to actual out-of-pocket costs incurred, but in no event shall such costs include attorneys’ fees; and (3) no punitive, incidental, special, consequential or other damages, including, without limitation, lost profits may be awarded (collectively, "Special Damages"). This Promotion will be governed and enforced pursuant to Ohio law, excluding choice of law provisions.
d. Promoter, in its sole discretion, reserves the right to disqualify any person (and all of their entries) from this Promotion if Promoter discovers that he or she has tampered with the entry process, the operation of the Promotion, or is otherwise in violation of the Official Rules or direction of Promoter. If a dispute arises regarding compliance with these Rules, Sponsor may consider, in its sole discretion, data reasonably available to Sponsor through information technology systems in Sponsor’s control, but Sponsor will not be obligated to consider any data or other information collected from any other source. Promoter further reserves the right, at its sole discretion, to modify, cancel, terminate or suspend the Promotion, or any part of it, if it is not capable of completion as planned or if any fraud, technical failures or any factor beyond the Promoter’s control, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion as determined by Promoter in is sole discretion. If Sponsor does so, Sponsor will award the prize for the Weekly Period in progress by randomly choosing the winner from among eligible Qualifiers for that Weekly Period and will announce its action on air. Promoter will not award the prize or prizes for remaining Weekly Periods, if any. Promoter’s failure to enforce any term of these Official Rules will not constitute a waiver of this provision. If there is any conflict between the terms of these Official Rules and any marketing or entry materials used in connection with the Promotion, the terms of the Official Rules will govern.
e. The Released Parties are not responsible for (1) typographical or other errors in the printing, the offering or the administration of the Promotion, or in the announcement of a prize; (2) entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties, malfunctions, disconnections, other technological failures, telephone service outages, delays, dropped calls, or busy signals; or any other difficulties that may prevent an individual from entering or participating, or (3) lost, stolen, mangled, misdelivered, misdirected, illegible, incomplete, incorrect, or late entries. Further, the Released Parties are not responsible if any part of a Promotion prize that cannot be awarded due to acts of God, acts of war, natural disaster, weather, acts of terrorism or other factors beyond the Station’s control.
h. To obtain a copy of the Official Rules or a list of winners following completion of the Promotion (please specify which), send a self-addressed, stamped envelope (VT residents may omit return postage) specifying “Official Rules” or “Winners List” to The Hot Clock Sweepstakes Official Rules, 1533 Amherst Road, Knoxville, TN 37909. A copy of the Official Rules and a list of winners (when complete) are also available during regular business hours at WKHT/Hot 104.5, 1533 Amherst Road, Knoxville, TN, 37909. All such requests must be received within 30 days following completion of the Promotion.
